Jay Finnecy Claudia Delgadillo - San Diego Superior Court - Chula Vista
Results
A 22yr old Female from Chula Vista was arrested and charged with felony driving under the influence of alcohol causing injury to another person. Her blood alcohol level was a .32%, 4 times the legal limit. She faced up to 3 years in prison. After several negotiations with the deputy district attorney, our client received only 90 days in custody and then probation which included 180 days where she must wear an alcohol monitoring device on her ankle.
Bradley Corbett Evelyn Rivera - San Diego Superior Court - Chula Vista
Results
A North County man was on probation for multiple domestic violence charges. He had been required to do several things as part of his probation but violated his probation by not completing what the judge had required him to do. He went to court and was facing the 280 days that the judge had stayed from his conviction. Our attorney was able to convince the judge to not take our client into custody for the 280 days and got the sentence for the probation violation reduced to 3 weekends in jail, thus allowing our client to be with his kids.
Bradley Corbett & John Masnia Evelyn Rivera & Pamela Mitchell - San Diego Superior Court - Vista
Results
A husband and wife were each charged with three counts of felony insurance fraud. The wife is not a U.S. citizen so the charges subjected her to deportation. Additionally, she is licensed by California to operate a day care out of her home so her license was subject to revocation. After negotiating the case, the prosecutor agreed to dismiss all charges against the wife (so she would not be deported and/or lose her day care license) and accept a misdemeanor plea from the husband which resulted in no jail time, only a fine and community service.

Results
A young navy petty officer was arrested for driving under the influence of alcohol. He failed the breath test; his blood alcohol was .09% and a second test registered .10%, both over the legal limit. We took the case to court and vigorously defended our client. The jury was not able to come to a unanimous decision and the case was dismissed.
Jon Pettis Rosa Perez - San Diego Superior Court - Central
Results
A young man found sitting in the driver’s seat of his vehicle which was stuck on a tree stump. The engine was revving and his friend was jumping up and down on the bumper trying to get the vehicle off the stump. The man was arrested and failed the sobriety tests. His blood alcohol content was .20%. Because of work done by our investigator, which included contacting witnesses the police officers did not talk too, the case was dismissed.

Results
A professional chauffeur was arrested for driving across the border from Mexico in an unlicensed armored vehicle, a misdemeanor. Our attorney was able to negotiate a complete dismissal with the District Attorney.

Results
A San Diego man was found to be in possession of 36 kilograms of cocaine. He faced a 10-year minimum mandatory sentence. Our attorney was able to get our client’s sentence reduced to a 37-month sentence.
Vince Ross Kathleen Hilz - Orange County Superior Court – Santa Ana
Results
A San Diego military veteran was charged with assault with a deadly weapon (motor vehicle) as a strike with a strike prior. If convicted, he would have faced a minimum of 7 years 4 months in prison. Case went to trial and our client was found not guilty on the primary charge, but was convicted of a simple battery which is a misdemeanor, as a lesser included offense. At sentencing, our client was only given 40 hours of volunteer work and 3 years of probation.

Results
A San Diego woman was arrested for driving under the influence of alcohol. She was observed leaving a bar by the police and proceeded to move her vehicle from one side of the parking lot to another. She was arrested and her blood alcohol content was .18%. He driver’s license was initially suspended, however our Department of Motor Vehicles expert attended her hearing and pointed out errors by the police officer in the DMV form he filled out. Our attorney was able to get her license reinstated. Our attorney also was able to negotiate a “wet reckless” plea which allowed our client to save her job and also no license suspension by the court.
Andy Schooler Rosa Perez - San Diego Superior Court / El Cajon
Results
A young San Diego woman was charged with three counts of making criminal threats, one count of harassing via electronic contact, one count of battery on a significant other, one count of vandalism, one count of child endangerment, two counts of battery, and one count of disobeying a court order for several different incidents. The prosecution wanted the defendant to plead guilty to four of the charges and serve 15 days custody, with 30 days of public work service, a 52 week DVRP, a 26 week parenting class. After ourr attorney had several negotiations at the City Attorney’s office, the client pled to making a criminal threat and to disobeying a court order and the eight other charges were dismissed. The court sentenced her to 40 hours of volunteer work, a fine of $704, a protective order of no negative contact, a 52 week DVRP, a 12 week parenting course, and stayed 6 days of public work service.

Results
A San Diego man was involved in a traffic collision where he collided with another vehicle in an intersection. There were conflicting statements by witnesses. Our attorney took the case to trial and was successful in bringing out the discrepancies in the case. The jury found our client not guilty all charges.

Results
An Escondido woman was charged with grand theft which is a felony and could have resulted in up to 1 year in custody. Our attorney was able to negotiate with the Deputy District Attorney and the charge was reduced to a misdemeanor petty theft with no jail time. The client was extremely happy with the results.

Results
Our client was found passed out in the driver’s seat of his car sveral blocks away from where he had been involved in a collision. The client’s blood alcohol content was later determined to be 0.26. A person who had witnessed the accident contacted police and gave them the location of the vehicle. At trial, the attorney was able to convince the jury that there was insufficient evidence to prove that the client was driving the vehicle at the time of the accident. The client was found not guilty of driving under the influence and hit and run.

Results
A San Diego man was arrested at a Chula Vista Police DUI checkpoint for driving under the influence of alcohol. He had a blood alcohol level of .09% an hour after the stop. Our attorney decided to take this case to trial and fought hard and challenged the evidence, the officers, and the experts through strong cross examination. He was able to poke holes in their case. The jury deliberated for 2 days and found our client not guilty on all counts. This client was thrilled, this verdict saved his career.

A San Diego man was charged with participating in a speed contest. If he had gone to trial and been found guilty he would have faced a fine of $1,400, five days of public work service and a suspension of his license for 6 months. Our attorney was able to negotiate and pled his client to a charge of exhibition of speed. This result is a fine of $600 and no driver’s license suspension and no work service.

Loan Modification Good Results

A San Diego couple client received a loan modification offer from Greentree Lending. Loan modification has been approved for $2,609.07 a month; previous payment was $4,740.00 per month. The interest rate dropped from 9.175% to 5.32% and the current principal balance has been reduced to $455,973.76 from $620,000. Results in monthly savings of $2130, yearly of $25,571.16, and a grand total principal reduction in the amount of $126,026.24!

A San Marcos couple retained in April settled on a loan modification on August 18th. Client's original monthly payment was $2,245. The original offer from Washington Mutual was $2,100 a month. Due to negotiations and client eligibility under the Presidential "Making Home Affordable" plan, client was modified to a monthly payment of $1,162.50. Loan Modification results in a monthly savings of $1,082.50, and yearly of $12,990.

A Rancho Santa Fe man received a trial loan modification offer falling under governmental "HAMP" program. The new payment is $2,140. The original monthly payment was $3,521. Client agrees to pay $2,140 a month for the months of September, October, and November; then a modification offer will be generated on parallel terms and payments. If client cooperates with trail plan, he will save $1,381 a month, and $16,572 a year.

A Chula Vista woman received a Freddie Mac (government program) loan modification on August 21. Her lender, Aurora Financial Services agreed to lower the woman's monthly payment to $1,392.02. Her previous monthly payment was $2,107. The client is saving $714.98 a month and $8,579.76 a year. The client had been denied 3 times prior to receiving the modification and had foreclosure proceedings delayed more than 3 months.

A La Jolla woman received a successful loan modification stemming from unique circumstances. Due to the misfortune of a family death, the women was left with her family's home. Unable to afford the payments, the lender agreed to modify the loan from a monthly payment of $2,456 to $1750, saving the client $706/month. The client is now able to make the payments and keep her family home.
